Help! I signed a lease on a new apartment in NYC and paid first month's rent & security. I told my broker I needed about a week to come up with his fee (15% of the year's rent), and he said he can keep showing the apartment to other people until he receives the money. Does this sound right? I thought last time around I paid the broker's fee as a separate, later transaction. If within the next week someone else wants the apartment, then I have to bug the owner for my money back?

I frickin hate looking for apartments here in Boston.
From my experiences here, what he said was totally accurrate.
Here, whoever has the money first, has the place first - regardless of how much you put down, if isn't enough, then they don't care b/c 30 other people will walk through that door and be glad to pay for the place.

That really sucks. I thought that if the owner has his money, then the broker's fee should only be between me and the broker. But everyone else I've talked to says what you say Happy.

Sounds Fucked up to me...Another reason why I'm glad to be in a area that when I sign the lease and start paying thats it...Sounds screwed up to me...But I don't live up in Yankee land and just wanted to chime in...

Question...If you signed a lease and started paying rent how does the broker have the right to show it to someone else, and even if he shows it how does he have the right to cut you out of the place? isn't that what a lease is for?

In Manhattan and Boston, in addition to paying rent you have to pay something called a "broker's fee" to the real estate broker who finds you your apartment. (In other cities, the owner pays the fee.) In Manhattan, the fee is 15% of 1 year's rent. I paid the first month's rent (for March) & security deposit, but I haven't paid the broker's fee.

Yea the cost of living up North is
definitely expensive, and then u got the lousy whether, but damn Id love to live in the middle of Manhattan in nice ass penthouse anyday!

yeah - I had to pay first month's rent, last month's rent, a security deposit, and a broker/finder's fee. each of those were a month's rent - so that was 4 * $1200 - that was a crapload all at once. I get the security deposit back and the first and last actually go to rent, so they are productive, but that finder's fee is annoying.

2 words- LONG ISLAND.

Cheaper, cleaner, quieter, much better in the summer and just a 40 minute train ride into the city.

That 40 minute train ride is just enough to sober you up a bit after a long night at the clubs. Plus it keeps you away from DWI-land. Or shall I say, Driving While on 2 hits of ecstacy and a half bottle of vodka land.

Have you signed the lease yet? If you signed the lease, then he can't keep showing the apartment. If not, Happy's right and if you don't pay it, somebody else will. It sucks, I know.

Latona-- I signed the lease and paid the owner first mo's rent & the security deposit. However, the owner hasn't signed the lease b/c my broker won't forward it until he gets his fee.

I had the exact same thing happen on my second apartment here. I was sharing it with 3 other guys and one of them was a total fuckup. he only brought one check along and then fucked up writing it so he voided it, and then he had no more checks. so the realtor kept showing the place and even though we had signed, the owner hadn't and she didn't want guys living there anyway (in Boston, if you own the place, you can legally discriminate for any reason you want)... it sucked - we eventually got it, but it was very stressful - there is an extreme housing shortage here, hence the high prices. when a place goes up for rent, it is usually filled in about 3 hours from when it is announced.

Damn, that totally sucks! I didn't realize realtors had that much pwer or could be such assholes. I guess you really don't have a choice, but that blows. If you can afford it, just pay. You'll be happy once you've got the place.
