Tortious Trend Is A Threat To Basic Freedoms

I'm sure this has been observed by others but!


This trend of litigating anything and everything is and will continue to be a threat to basic freedoms!


"They" are using this method to circumvent the 2nd ammendment to attack gun makers


"They" are the reason ephedra products will be much harder to find


Is there any hope for reform?
 
Any kind of tort reform would mainly help the insurance companies. And the insurance companies wont pass the savings on to the consumers because they are a bunch of money hungry jerks.
 
I completely agree...they are using the gov't, or should I say the gov't is allowing litigation so accomplish their agendas.
 
I am on theinsurance side of the tort issue at work.

All I can tell you is, the only ones this benefits are attorneys. Insurance, litigation, etc....it increases the cost of everything for everybody. Dispensing with much of the tort litigation that goes on could improve the economy dramatically.

It is usually unfair to bame one political party for something, but tort lawyers contribute exclusively to democrats.

Bush could be a herp if he did something about this. he could jump start the economy and actually change ouir litigious culture to a degree...

Seriously, tort reform is one of the most important, least talked about issues in the US. I know that Bush wants to initiate tort reform but its an uphill battle. Attorneys are right up there with unions as far as lobbying power. If this is important to you, you must vote republican. Many people say that big business in in republicans' pockets. Attorneys are in the democrats' pockets. There will be no tort reform if democracts are in power.

I am not up on the specifics of the tort reform ideas, but is it only dealing with caps on awards?

I feel that the root of the problem is the mentality of the judicial system. Cases that would have been laughed out of the court in years gone by are now common events. Judges today lack the fortitude to do what is right and simply cater to the lawyers and bar associations.

Deep pockets = liable party - even the government is in on the act with Superfund.

Tort law has become a way to take money from groups that have a lot of it.

Tort law is also a metrhod, though crudfe, of regulating corporate and professional misconduct.

it's not an easy issue. I agree with your point on judges.

Tort reform won't likely happen. Lawyers are the one's that benefit the most from litigation whether it's initiating lawsuits or fighting law suits, litigation keeps them employed. Now guess what? Most of our law makers are what?...That's right. they're lawyers. So passing reform to limit lawsuits is sort of like putting themselves out of work.
