I believe he did fight in the prison uprising, which is where he was found. The reason he was in the prison is because he surrendered with 6,000 other Taliban fighters.

Even if he didn't fight US forces, he fought for a regime that harbored and supported the terrorists that were responsible for the September 11 attacks. I'm not a war monger or anything like that, but I say he deserves to be skinned alive for what the families of the WTC and the Pentagon victims are going through.
