I love this conspiracy shit... Fonz posts some excellent stuff, but I stumbled across this "31 Question" forum and read just enough to make me want to do a bit of my own research. Has this been posted before? I couldn't find it with a search...

Is nothing as it seems??? Or is there a controversial side to just about everything???

I don't know.. but I filed my taxes in feb, then did a ammendment in early march. and just now found out that I wont be getting my return untill LATE MAY!. damnit.. I have to wait longer than the people who filed on the last possible day.
 
Nothing new....

I've heard for some time that the IRS is an illegal construct.

Supposedly, the power of the federal government to tax is an "implied" power of the constitution as you need taxes to pay for the duties the federal government is charged with.

However, it appears the IRS is a 100% illegal construct. I know their powers are unconstitutional, but they get away with it all the time. :mad:
 
The IRS is a 100% illegal construct. THE ORIGINAL US CONSTITUTION nowhere said that is was legal and legitimate for the federal govenment to collect federal income tax. It stated that the only form of INCOME tax that could be collected would be by the STATES. Furthermore, the Constiutition stated that federal tax could only be collected on certain items, like Customs duties, etc.----but no federal income tax. The federal income tax that we have today should be demolished. I suggest that everyone stop paying federal income taxes immediately! Or, at least, lie on your tax returns to pay as little as possible.

Some of that stuff is true, but the government can and will take your money. Rich people go to jail every year for tax evasion. If anyone has the coin to fight the government it's them and they lose every time.

Article 1, Section 8: "The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises, to pay the Debts and provide for the common Defence and general Welfare of the United States; but all Duties, Imposts and Excises shall be uniform throughout the United States."

Powers Denied to Congress
Section 9: … "No Capitation, or other direct, Tax shall be laid, unless in Proportion to the Census or Enumeration herein before directed to be taken."

The Constitution makes clear that the current Income Tax is unconstitutional, and the Supreme Court ruled this several times over the years. The idea of making an amendment to circumvent this is also unconstitutional, for if the Constitution binds government from doing something and the legislature can override it, then what value is a constitution?

I agree with you in principle. I also live in reality.

Lincoln tried to impose an income tax and it was found unconstitutional. Congress just did an end run on it with the 16th amendment.

The climate of the era as I am sure you know was post Industrial revolution and the "get the rich" mentality was in full swing.

It was stupid classist legislation.
 
The 16th Amendment isn't an "end run" - it's the correct way to change the constitution, not like some of the crap the feds pull in other areas (like the drinking age - the Federal government has no power to regulate sale of alcohol, but they just tell the states "do what we want you to do or we won't spend any federal highway funds in your state, even though your citizens pay the federal highway tax on gasoline. THAT'S an end-run.)

The bottom line is, the current, sitting US Federal Government should be overthrown, the two-party, corporate supported system of politics abolished---as well as the winner takes all system of politics----and subsequently, new elections should be held. Wherein, the Federal government will revert to it's original powers and authority as the US Constitution originally stated. Also, the Federal government will be more reflective as it was originally directed to be in the US Constitution as per the writings of the GODFATHER OF THE LIBERTARIAN PARTY---my hero, and the hero of all Libertarians----US Constiution writer and President THOMAS JEFFERSON.

I understand, but principle is what the Constitution was founded on. This is a major problem of society, to many are afraid of "what ought to be" and would rather accept "what is".

It is the root of the two party system. How many times have you heard either Party attempt to steer voters from voting based on their principles using this mentality? Republicans telling conservative minded voters not to "waste" their vote on say a Libertarian candidate, or Democrats telling liberal minded voters not to "waste" their vote on say a Green Party candidate. This mentality perpetuates the "is" and not the "ought be".
