my friend is on probation for possetion of a ounce of coke.
A few monthes ago the police entered his house at about 3 AM in the morning to ask him some questions. The did not have a warrent, the door was unlocked and they woke him up at gun point.
They knew he was on probation and they smelled alcohol on his breath, they asked him if he had been drinking(he had) and he told them yes...(stupid i know but they could have given him a breathalyser)
anyway so he went to court for parole violation, defended himself
(everyone told him to get a lawyer, but he makes 8 bucks an hour) and lost. he got 6 monthes in a half way house where he has to pay 525 a month (in addition to half of his apartment) and bus to his job from about 60 miles away.
anyway, heres my question: were his rights violated at anytime?
Is it possible to appeal the courts decision?
