Probable Cause?

Hey, this doesn't pertain to roids exactly, cause they didn't find my clen...But, I believe that the police entered my house illegally on Saturday night. Any advice or help is appreciated.

I am a 20 (almost) year old college student. Last night we watched our horns whoop Arkansas and then had a party afterward. Around two, a cop comes to my door and demands to see the owner because they got a noise complaint, I didn't answer him right away and made him stay put at the door. I had actually not been drinking because I am coming off bronchitis and I am still taking codeine to help with my cough. I turned off all the music and told people to be quiet before I would talk to him.

So… He puts his foot in the door and says he knows there is underage drinking going on because he saw some people (two or three, and they did not have alcohol in their hands) in the front run inside when he approached the house.

He tells me to step aside or he is going to arrest me and take me to jail. He then goes inside a few seconds after his partner opens my fence’s door and walks into back without permission from me.

They then call TABC (Texas Alcoholic Beverage Commission- which their only job is to stop underage drinking) who comes and issues tickets to twenty or so 19-20 year olds while letting all of the 21 year olds leave. They searched the entire house for alcohol (and boy did they make me pour a lot down the drain) and opened up and searched almost everything.

Now, I know I am basically ok, I only got an MIP (minor in possession). Of course, being in college, I have plenty of friends who have gotten them and usually it comes to be 60 bucks court costs, 8-10 hours community service and an AA class. It could have been a lot worse, they could have given me contributing to the delinquency of a minor (twenty times over actually) which carries a $4,000 fine and a year in jail for each count. They still have two years to press charges, so they threatened me “if you screw up and we come back out here, you are going to jail on this party and the next one.”

So, what do y’all think? Is a noise violation enough to come inside, is that really probable cause? I want to fight it, but I don’t have money to hire a lawyer, could I qualify for legal aid because I have no income?

I am basically shit outta luck and need some advice from some people who have been there before. I appreciate y’all’s help.

One more thing, there is a silver lining: at least we floated the keg before they confiscated it. ;)

sounds about right and so far like you got off easy but well see how it ends up going down, unfortunately for you now the paranoia will start, any time drugs/alcohol/music are involved youll be thinking, is the music too loud? who is watching my peeps on the porch and which one of my fucking neighbors dropped the dime anyway?
