Lawyers File Class-Action Against McDonald's Claiming Its Burgers and Fries Are Making Kids Fat

N E W Y O R K, Nov. 21 — Are Big Macs hazardous to children's health?

Lawyers have filed a class-action lawsuit against McDonald's on behalf of New York children who have suffered health problems, including diabetes, high blood pressure, and obesity.

In federal court in Manhattan on Wednesday, a lawyer alleged that the fast-food chain has created a national epidemic of obese children. Samuel Hirsch argued that the high fat, sugar and cholesterol content of McDonald's food is "a very insipid, toxic kind of thing" when ingested regularly by young kids.

The plaintiffs include a Bronx teen who ate every meal at McDonald's for three years while living in a homeless shelter. Another is a 13-year-old boy from Staten Island who says he ate at McDonald's food three to four times a week and is now 5-foot-4 and 278 pounds.

McDonald's lawyer Brad Lerman insisted the lawsuit was a frivolous attempt to cash in on the Golden Arches, "the kind of lawsuit that shouldn't be in court."

"People don't go to sleep thin and wake up obese," Lerman said. "The understanding and comprehension of what hamburgers and french fries do has been with us for a long, long time."

McDonald's has asked Judge Robert Sweet to dismiss the case, arguing those who filed the claims cannot show their health woes were caused by Big Macs and insisting the company has never misled customers about its food. The judge did not immediately rule on the request.

It is a shame that people try to put the blame for their own mistakes and stupidity on everyone else but themselves. Americans are spoiled and lazy compared to most other cultures. Suing has become a way of life in the U.S. as a way to get $ without working for it.
 
I beleive that we are the only industrialized country that has not instituted the law of "loser pays" when it comes to lawsuits.

i don't like the idea of 'loser pays' with lawsuits. a lot of times it's a middle class person suing a large corporation. the corporation can afford high priced lawyers and if the case goes on a while the legal fees begin to stack up.


ps- i've never taken a bite of a big mac in my life. just thought i'd share that.
 
i think the lawsuit has something to do with McDonalds not openly posting how fattening their foods are. I admit that someone must be pretty naive to not know how fattening McDonalds food can be, but that is one of the main cruxs of the argument.
 
I think the fat in the food is less of an issue than the simple sugars.
hell, they add sugar to their meat (although that actually helps keep the carcinogen rate down in the cooking process... if you are grilling meat - not sure what they do, but I doubt they grill).

the prob with mcD's is the insulin and the fat - we all know that fat in itself isn't the issue.

I'm not seeing the problem, those stats seem pretty solid to me. I hope the kid keeps up the good work. For me cutting was easy, putting on the weight was always hard.

If the middle class person has a legit suit then THEY WILL WIN and thier legal fees will be paid by the large corporation. Any lawyer with half a brain in his head will be able to surmize whether or not their middle class client even HAS a chance.

Your post is totally illogical. Do you have much experience with tort law?

With the current legal fee model, if Joe MiddleClass wants to sue BigCorp, Inc. Joe has to spend the money from Day 1. Under the new model, if Joe wins, he wouldn't have to pay anything.

Therefore, middle class, or poor, people wouldn't bring lawsuits unless they were winnable - i.e. legitimate. Lawyers wouldn't take the cases unless they theought they were legitimate. And only legitimate cases should be heard anyway.

98% of cases end in settlement - only 2% ever see a trial. Lawyers take cases on a contingency basis aiming for a settlement. This is inherently flawed.

Class action cases are the worst imaginable - often generating millions in legal fees without much in the way of resolution for the plaintiffs. I could cite you 1000 of these.

The current legal system is among the largest drags on the economy.

.... last week, as part of my cutting diet, I ate two triple cheesebugers from Wendy's (without the bun) and a large diet Coke...... The fat girl behind the counter gave me a wierd look, then looked at my waist. :rolleyes:

Dietary fat is not the problem, it's the combination of sugars and fats that are the prob.

I've been down that road and it's not that easy or fair. AT ALL!
 
This is such total bullshit. I think it is damn clear that the large corporations of America are on our sides and just want to help us.

Fat people who dine on fast food are their own worst enemy. However, McDonalds almost seems to go out of its way to produce patently unhealthy food.

What will inspire a change in ethics at McDonalds?

Obesity in the country is sickening. One used to be able to girl watch at the mall. Then one had to go the lake. Now one has to go to Hooters or a strip club to see healthy girls in interesting attire.

Even the health clubs are loaded with fatties. :(
 
It's all because we people don't spank their kids anymore. Ever since they took the paddle away from the school teachers these dang kids have been gittin fatter and fatter.

2) Is is generally defense or plaintiff?

If people aren't smart enough to control what goes in and out of their mouth or other bodily orifices (sp?), they deserve what they have coming. Nobody makes someone eat anything, except maybe Knight69 or his wife.

If some big fat diet coke drinking tub of goo wants to suck down big mac's like oxygen, they have to deal with being a fat ass and don't have anyone else to blame but that obese fat fuck staring back at them in the mirror. Why blame someone else? Because they can in this litigious society. Actually, McDonalds should just look at these fat bastards as stockholders instead of plaintiffs because the money they win will eventually wind up back in McD's cash draw for Big Mac's. Just like taking money out of one pocket and putting it back in the other. It's almost just a reallocation of capital, you know, cooking the numbers or books so to speak.

Anyways, lets examine this from a health socio-economic stand point.

Obese people use medication for high BP, diabetes, heart, etc. etc.. this costs the US BILLIONS

Now, these obese people are suing the fast food companies?

Result: They get money.

For what?

To eat more and get fatter.....probably.

I'd rather they get money that is forwarded for a simple education in nutrition for all of them.

But that just won't happen.

If they do get the money, they'll use it up.
(And get fatter probably. Their kids too)

More obesity = more drug use because of obesity = more revenue for drug companies

Its like a merry go round.(sadly)

The only answer is education but with the "Food Pyramid" BS
the government is touting I doubt the problem will get solved anytime soon.

I encountered something very sad today. A father and his five year old daughter came into my shop today. The father wanted to know what I suggested as sizes for his daughter. After engaging in a conversation with the father I came to find out that his daughter weighs close to 140 pounds and has a 38 inch waist. .

This had to be the saddest shit I have ever seen. I truely feel sorry for that little girl.

When I homeschooled my daughter last year I had ordered some charts/posters. One of them was the Food Pyramid. The gov't. has kids learning that they should be eating more cereals and breads than anything else...why?

10 - 15 servings of carbs (starches and fruits) a day and only 2 - 3 servings of protein??? It's just totally fucked up!!!

Even in her school this year (a private school) they were "teaching" good eating habbits and had the kids make up sample menu's to include snacks...snacks being loaded with fats and carbs instead of healthy choices.

As for blaming McD's for not telling us what's in their foods, that's bullshit. I remember seeing a list of the callories and fat content of their foods inside McD's a few years ago. They do offer salads now, but most people pour on so much dressing that it's not a healthy choice.

It's just ignorance...unless you've done some real research, you won't know the truth. I know, I've been there. I can remember going to Weight Watchers meetings with my mom when I wasn't even 10 y.o. yet. The average person is really clueless when it comes to nutrition.

Something Dr. Atkins said once, comes to mind...something about the food manufacturers being able to make more money on processed foods as opposed to raw foods...it's all a money game. Not much money in it for the companies who sell plain chicken and beef and brown rice, is there? Hershey's is a much more profitable corporation, therefore more advertising and pushing it down the throats of Americans.

Enough...I'm getting pissed off here.
