Smurfy said:i have worked in the child welfare field for the past 10 years. unfortunately, when cases like this arise, it is because of the negligence on the workers part. there are people working in this field who dont give a rats ass about their job hence why something like this goes unreported until you have a 19 yr old boy who weighs 45 lbs. its the workers who fuck up by not monitoring these children appropriately. they lie about seeing the kids month to month. this type of thing happens in every state And it is a disgrace.

States can preclude suits with legisaltion.
For example, if you are are arrested, jailed, tried and acquitted, you can't sue the state to recover your legal costs.
If you are convicted and later exonerated, states have passed laws that limit what you can receive.
States insulate themselves from negligence all the time. It's called "sovereign immunity" and it is very real in the US.
