I need help throwing someone out(or atleast some advice)

Ok,Heres my situation My current GF has a Rental condo unit in Aventura florida.She went into a verbal agreement(because the guy was a supposed friend)And now he refuses to pay and is 3 months behind(1400.00 per month)Now If this girl wasnt so damn hot,cool,and helpless I probably would not give 2 shits But shes a solid citizen.Now,Outside of me flying down there and physically throwing this dickhead out(which I dont mind)What the hell else can she do?I called the police they say its a civil matter(lease or no lease)And I need to go thru the court system(300.00 to get started)This shit piss's me off and If he wasnt 1000 miles away I would take the chance of getting arrested and drag his ass out by his nutsack.Any help or advice would be great.Later
 
Sorry man but your lady has to handle this one on her own.

It's a civil matter and she has to file the papers and get his ass out herself. You flyin over there and tearin up the dude's ass will only net you a wholelotta legal fees and fines when you are going to have to defend yourself in court 'cause pussies like this WILL SUE YOUR ASS.... and guess what? THEY WILL WIN.

She is a grown woman and unless he feels threatened by his presence *hint* *hint* she will just have to file and see his ass in court. Now, if he were to become beligerent, shouting at her and threatening her in addition to being 3 months behind on the rent, she could trot her ass down to the local police and file a restraining order that would get his ass out of the place ASAP. She would have to give him a time to pick up his belongings - police would be present - NOT HER then she could go about her business happily while waiting for her day in court to get the back rent.

Simple... shmimple. You gotta know which side of the law to stay on there big guy.

No one deserves to have their ass kicked more than my ex but that is not for me to dwell on or mete out. And I won't EVER...

All your girl has to do is enlist a bit of police assistance because "she feels threatened." Are you understanding what I am saying? :biggrin:

All she has to do is give a very simple story about how he makes her feel very threatened because she has been demanding the rent. Obviously if the guy is brazen enough to let a situation such as you stated (3 months behind over 1K each month) would most likely be brazen enough to become hostile towards the lady. Police don't play when it comes to shit like this... as they shouldn't.

If she shut his utilities off and he *did/said anything to intimidate/retaliate* the story would make A LOT of sense so that she could easily defend it in court.

If she tells a story that is totally fabricated (remember within every misrepresentation lies a kernel of truth), a judge with HALF a brain will catch on.

If she is telling the truth... all the better.
 
I don't know about in Florida but in RE you have to have a written contract and conversion (money exchange). If you don't have a written contract you will need legal advisement.
Was there ever any rent paid?
If so was it in cash or a check?
If is was cash did she give him a receipt?
If you have the power turned off that is not a good thing, atleast in California that is harrasement. You have to follow the letter of the law, if you don't it will add to the time of evection and cost more money. Potentially giving him the opportunity to file a cross complaint if there is something that requires power. Say he works from his home and is unable to work due to no power. You/she may be responsible for his inability to work.

FYI - I filed restraining orders TWICE. Both times I told total truth. My ex lied through his teeth both times. First time I got a Final Protective Order (near impossible to get in the midst of divorce/custody battle). The second time I didn't get dick. The funniest part of all that bullshit was that I was nearly arrested TOO because "my ex suddenly remembered" that it was me who threatened him - not the other way around as it was 3 times prior - 'course he only had his memory jogged AFTER he was arrested for threatening me. :rolleyes: I was arrested with my two older children in my custody. The police only stopped the booking process when they realized what my ex had done. When I first entered the police station (a cop was waiting for me at my kids' school when I picked them up) and I came with him because I thought it had something to do with my ex threatening me. WRONG!!! Long story short... charges went from arrest with no bail to release on my own recognizance in bout 30 minutes.

It is ALWAYS a crap shoot in that there is no truth, but only perception. :whatever: For all we know SHE COULD very well feel threatened.
