I got an offer on a settlement from that contractor..

He sent me a certified letter asking if I would agree to $24,500 to drop my lawsuit.

Have not yet decided what to do.
 
How much in actual damages and fuckups cost ya?

Do what you do best, give him the big dicking of his life right up the ol'poop shoot. Make it something he will never forget.
 
Well by Florida Law, the amount you get in court is 3X the damagaes, repair costs and attorney fees. That would bring him to around $65K.

I never paid him anything. Remember that. He put in writing the job was $7000 and three weeks. 14 weeks later with the job about 40% complete he tried to give me a bill for $27,200. I fired him and never paid him a penny.

Also, in the writing for the $7K cost, he included the fact that he would take $4500 off the bill in exchange for the big screen HDTV ($3000) I was selling and my old office desk ($1500). He took these items home with him and has never returned or paid for them.

I got another contractor to come in and finish the work for $6000. Also, I had a repair bill of $4000 for my swimming pool pump and filter system where he shattered two sliding glass door through each other and into the pool.

So in all, what I have paid is:

6K for the work - second contractor
4K for the pool repairs
and still missing $4500 worth of property he took.

That is a total of $14500 right there.


I am going to have my attorney counter with $24,500 plus attorney fees.

I am sure the courts will rule in my favor... but however, if they do - there is no gurantee I will collect anything. He can declare bankrupty or just shift assets to another company.
 
shouldn't the first "contractor" (and i use the term loosely here) be talking with your attorney about a settlement offer?

why should you do all the dickering (no pun intended!) if your attorney is going to reap part of your settlement?
 
The contractor is using his wife as his attorney. He sent both my lawyer and I a copy of the letter.
 
ahhhhhh..........that sounds correct.

i'd wait until the trial date; his "court house steps" settlement will surely be more lucrative than his current offer.

Go with the above offer as it is 2x the out of pocket and your legal fees..

More than enough for your(and our) suffering, and it is likely that you will actually get these $'s quickly...

Did it turn out he doesn't have professional insurance?
Surely if he was insured, his wife wouldn't be handling the case.

Pic 1 - Does this post look straight?

Pic 2 - 11 weeks later and despite me telling him, emailing him, leaving notes thumbtacked to the post and drawing a map on the floor in chalk... does it still look straight?

somehow, he managed to dry wall it, sand it, paint it and still not notice it was crooked.


Pic 3 - Typical example of his workers... they dry walled over the electrical outlet. Then when it came time to find it, they were not able to interpret the blueprint and see the location... so.... the brain surgeons just started cutting holes in the wall until they found it.

Pic 4 - See that post. That huge one behind the couch? It was suppose to come out. Completely. He swore that he "thought" they took it out. When I brought him back, he couldn't believe it was still there. I mean... sometimes you really over look something that fucking big... especially when you have to walk around it 14 weeks.

Pic 5 - These "used" to be arches. Perfectly symmetrical arches. Do they look all the same height? No. Guess why? He cut one of them down. Hell it was December, everyone was chopping down Christmas trees, but here he was chopping down my fucking arches. Not that he built them. They were already there for fucks sake. What does he do then? To correct it, he builts the supporting posts back, but at different heights. Boy that was slick. Sort of like I wouldn't notice that for a few years.

Ok.... now all the pics I just posted were of work he was NOT suppose to do. All he was suppose to do - if you look in Pic 4 - that back glass wall - all he was suppose to do was move that wall back 6 feet. That is it. Nothing else. Just move the wall back. In other words, he was suppose to take that sliding glass door out and put a track into the ground by the pool and enclose that area. I already had three walls and a roof there. I just needed the door moved back 6 feet.

Geeesh, You've been thru hell and back with these worker's! Someone needs to have 'em get their eyes checked too!

It does look like a very nice home, AAP. I love the granite flooring and your furniture style.

Hoping you can look back SOON and say it was all worth it!
 
We are building a house, and it is amazing how seemingly major
things can be missed and noticed by us construction novices..

Do you ever have people walk thru the skinny sides of the arches for fun ?
