What are the pre-requisites to have your car searched?
Is it like a house where they need a warrant?
If you deny them the police the right to search, then what?

probably manny could answer these for me :D

ive refused to have my car searched
so , they couldnt

i think its different if they suspect guns/drugs though
 
Simple solution.

Any time a cop in Canada asks you to do anything ask him:

"Am I under any legal obligation to...(talk to you, let you search my car/house, etc.)

If you're lucky and you're not alone (witness to his response), he's fucked.

If he's an RCMP, he will likey respond with a good answer such as "I'm smelling what I believe to be marijuana smoke/you match a description of a suspected blah, blah, etc."

In which case, he pretty much does have the right.

RCMP are ALOT! better than our crappy city cops when it comes to proceedure regarding routine stuff.

Heavy investigative proceedures are not much better than those of the american nazi cops but if you're under a serious investigation, you've got bigger problems anyway.

In most provinces there are free legal aid phone numbers that link you to practicing lawyers and you can get questions like these answered. Look in your provincial blue pages for those numbers.
 
you have the right to refuse them to search your car. i was stopped once and decided to be a dick to SQ (quebec provincial police) and told him NO, he had my car towed claming "it needs to be inspected by our mechanics"
 
You should ask"what conclusion do you have that my vehicles needs to be inspected for safety" was your vehicle fit for the road? If it was, bring the car immediatly to two auto shops get it certified. Take pictures then go to a lawyer. I had a cop try to pull that on my mustang, I have a 310 s,m,t Tech license I did not mention that to him. Anyway it reached a point that I wanted him to take it in, I pulled out the highway traffic act that I have in my truck. I pulled out the tools to inspect the car right there in the spot, in the end I know that my car meets the highway traffic act. I was the one who certified it, anyway I put him in his place. All you need is the evidence don't get intimadated.

kind of after the fact, when you have two cruisers show up and a tow truck ....fuckers took off their name tag before i could write down their names and file an official complaint against them

Easy, when I was young and the cops would take off their name tags/numbers, I just looked at the cop car with the fleet number (c35, or something easy to remember). They have to sign out the fleets and it's YOUR right to phone the station/detachment and inquire which officers (officer ID # if not name) were in unit "whatever" at 3:00 am Friday Nov. 8.

They can answer without putting you on hold most of the time.

I had a cop confiscate a knife of mine (a very nice one) that I KNEW was not illegal, and there was no reason for it. I never got his info but I knew the car number (cause I had my face shoved into it...lol!) and got my knife back after talking to the staff sargent on the phone about 1 hour after the cop took it from me. Staff seargent said "You can pick it up in the morning. I'll see to it."
