controlled substance

when a chemical is deemed to be a danger to public health, or whatever, which organization makes the decision to write an application for it to be a controlled substance? is it the DEA, FDA, FBI, NSA, CIA, WWF:p WHO, NRA, ATF....etc. :confused: basically, i'd just like to know the process of determining a previously legal chemical to be controlled, such as the case with GHB and GBL (by the analogue rules GBL is also controlled like GHB).

that would be the ideal scenario for the case i'm currently working on, but i would need a definitive answer. i wonder if whatever agency is responsible for putting things on a controlled substance list does so because it takes a lot of heat when people misuse a chemical and die from it...
 
DEA primarily. Remember, the FDA has actually voted AGAINST the scheduling of some substances, including, believe it or not, steroids. However, a special order can be issued, as was the case with GHB, where the attorney general is involved directly.

Is the issue about GBLGHB? Email me for details there. The laws, as they currently exist, are clearly unconstitutional in a variety of aspects, and they are generally easily rebutted.
