Governor signs bill banning realistic-looking weapons in public

ABOUT THE LAW

A new state law prohibits the use of toy or imitation guns in public unless they are clear plastic or painted a bright color. Fines range from $100 for the first offense to $200 for the second offense and a misdemeanor charge for three or more offenses.

Salinas police say they overwhelmingly support a new state law that prohibits displaying toy guns in public unless the weapons are clearly fake.

"If it discourages people from carrying realistic guns, it can only help in preventing potentially tragic confrontations," said Salinas police Lt. Kelly McMillin.

On Monday, California Gov. Arnold Schwarzenegger signed Senate Bill 1858 by Sen. Joseph Dunn, D-Santa Ana. The law requires that for toy guns to be shown or played with in public, they must be made of clear plastic or be painted a bright color so that they are not mistaken for a real firearm. The law took effect immediately.

Those who break the law face a $100 fine for the first offense, $200 for second offense and a misdemeanor charge on a third or subsequent offense, according to a statement from state Attorney General Bill Lockyer's office.

Deputy police Chief Rick Moore said Salinas officers have had numerous close calls involving realistic-looking toy weapons.

Earlier this year, an officer investigating a call of a person with a firearm came face-to-face with a boy holding a paintball gun, Moore said.

"The officer, through all of this, realized it was a paintball (gun) and didn't shoot the kid," he said.

Some of the imitation or toy guns Salinas police officers have confiscated look so authentic they're dead ringers for the real thing, McMillin said.

"When a police officer sees somebody with a weapon, you have seconds or fractions of a second to make a life-or-death decision. You certainly don't have time to inquire about the authenticity of the gun."

Along with cap guns or other toys, the law also applies to airguns, including the BB and pellet variety.

The law requires that imitation firearms manufactured after July 1, 2005, have a warning label that states the law.

Theatrical productions and sporting events that use imitation guns are exempt from the law.

The legislation also allows prosecutors to file additional charges if someone uses a realistic-looking fake firearm in a public building, airport or school.
 
That is bullshit. If I had a 5 year old son playing with a toy gun that looked too real and some cop tried to write him a ticket, I would take his gun from him and use it on him.
 
what the hell, that would really take away from your childhood experiences plinking squirrels with you BB gun

of course this will certainly result in criminals painting their own guns lime green and florescent pink to elude detection.
 
i had the most realistic looking toy guns when i was growing up. one was an exact copy of an uzi with an extended magazine (it was an electric water pistol), several realistic cap guns, and a plastic version of a colt 1911 that shot rubber bullets.

i'm sure there were more, but that's all that pops into my head.
 
Ya I had some pretty realistic guns as a kid.. we carried them EVERYWHERE..

I guess the low IQ Miltary Policemen were much smarter than the average cops of today.. none of us ever got shot, stopped or harrased.

"HEY YOU, IN THE SCOOBY DOO SHIRT AND POORLY MATCHED PANTS!! PUT DOWN THE UZI AND STICK COVERED WITH TIN FOIL TO LOOK LIKE A SWORD!!!"
 
I can kind of see his point if it's an adult brandishing an imitation firearm, that could lead to them getting shot if they thought it was real. However, I've yet to see a 5 year old with malicious intent when waving his water gun around ;)
 
hell yea i had plastic M16's that looked damn real and even old school WW2 type rifles there were actually made out of wood/metal and stuff

everyonce in a while i'd get one that had the orange tip on the barrel but that was nothing a quick trip into dads work bench couldnt fix with some spray paint ;)

Right, I had a pretty realistic looking m-16 and colt 1911 when I was a child and not once did a cop ever stop me or my freinds when we were playing with them shooting at each other etc thinking that we had real guns.

This is so rediculous.

Exactly. Now if a 20 year old was running around with it.............then I can see where he's coming from
 
WOW Cali has its priorities straight ! One of the highest debt, illegals flooding, many business getting the fuck outta there but hey, let's focus on toy guns, .50 caliber rifles and SUV. That state is fucked up, probably 20x more than Canada...

I think I had that same uzi water gun...

I also had this METAL toy revolver that had realistic racheting motion and was made out of solid chunks of metal (not hollow) - it even weighed a couple pounds... I was like HELL YEAH when I got that thing - then my g-ma took it away when she saw how real it was... :(
 
I had a metal bb gun that looked just like a .357
The problem is there are plenty of young kids out there with real guns, and they really kill people.
Which leads to cops shooting and killing little johnny for waving around his squirt gun.
This is the kind of thing people love to complain about, but it's a good law.

No, no numbers, and Im not going to look up how many murders are commited by juvies.
When I was a kid (15) I got sent away for a bit and there were kids in there for murder.
I'm not on the police booster club, but if a kid has a real looking gun in thier hand they could get shot. Some 13? yr old got killed by a cop locally, I believe he had one of those black plastic uzi squirt guns.
I dont know about in your towns but kids here are pretty violent.
A group of 12-17 yr olds beat a guy to death in the park the other day. Maybe WA state is different than everywhere else.
