I got the same thing going on with this kid who gave me $1000 dollars for holding a sport bike for him and he would pay me another 3000 when he gets, well 3 months go by and I get a phone call saying he doesn't wnat it anymore and then gets his mother to call me and tell me to give him back his money.

I had a legal document signed by him and witnessed by a 3rd party. That in any event this money was non-refundable, and also told him that I refused 3 other offers 1 more than my asking price. Long story short I had every right to keep that hold money,but gave it to him after he gave me some pathetic story.

The seller is in your case is in the right and the money you gave him is forfeit sale or no sale.

put a lien on the car so when he goes to sell it you are guarateed to get your money.
your do own a portion of the car and can collect. if he sells it and you are not protected then good luck. a lien will force him to settle it with you before title can be transfered.
have your attorney hekp you with it.
you can eventually get your cash back even though you don't deserve it.
