Has anyone dealt with the police with a case involving GHB - gamma hydroxybutyric - ? I'm going to need some serious advice from people who are experienced here! I was at a house where a kid OD'd on it and I just received an indictment for "dispensing" it. I think someone is pinning it on me but I was told not to contact them. I'm not sure if the police are fishing ( I doubt it since I've been indicted ) or if someone in the house was in trouble and pinned it on me to get out of there trouble. I have been told 3.5 to 7 years on this felony. The kid is okay... | |

| You need to get yourself a lawyer immediately! Both state and federal authorities have turned their sights on GHB - gamma hydroxybutyric - in the wake of the "date rape" cases that have surfaced in the past couple of years. The penalties are serious but it of course matters whether it is a state or federal case. The best advice you can get is to hire a lawyer right away and not say anything without your lawyer present...especially if you truly had nothing to do with this. An indictment means that evidence has already gone before a grand jury. Why have you not been arrested yet? | |

Here are a few cases but you might be dealing with local PD DEFENDANT: Gary (Last Name removed to allow privacy), at Dallas, Texas (N.D.Texas); Criminal No. 3:94-CR-102-R. CHARGED 3-24-94: Count 1: The defendant knowingly made a false statement during an inspection where he told FDA agents that he had not received any products containing gamma hydroxybutyric acid (GHB - gamma hydroxybutyric - ) from any other supplier when, in fact, he had received GHB - gamma hydroxybutyric - products from at least one other source--18 U.S.C. section 1001. Count 2: The defendant, with the intent to defraud and mislead, caused 50 misbranded bottles of GHB - gamma hydroxybutyric - to be introduced in interstate commerce. The bottles were misbranded in that they were in package form and did not bear labels containing the name and place of business of the manufacturer, packer and distributor or an accurate statement of the quantity of the contents in terms of weight measure and numerical count--502(b). The bottles were also misbranded in that the labels failed to bear the established name of the drug and adequate directions for use--301(a), 303(a)(2), and 18 U.S.C. section 2. DISPOSITION: Guilty plea; sentenced to 33 months in prison and three years of supervised release. (F.D.C. No. 66859; S.J. No. 11) -------------------------------------------------------------------------------- DEFENDANT: Jeffrey (Last Name removed to allow privacy), d/b/a Champion Distributors, at Horsham, Pa. (E.D.Pa.); Criminal No. 92-0009-01. CHARGED 6-6-91: Count 1: The defendant caused to be introduced into interstate commerce a bulk quantity of GHB - gamma hydroxybutyric - which was misbranded in that the labels failed to bear adequate directions for use--301(a), 303(a)(1), and 18 U.S.C. section 2. Count 2: The defendant caused the introduction of an unapproved new drug into interstate commerce--301(d) and 303(a)(1). DISPOSITION: Guilty plea; sentenced to 18 months' probation and fined $500. I have a date in about one month to go to Superior Court and enter a plea... where I will then be arrested and have to post bond. I have found out quite a few interesting things on my end that should be a slam dunk for me... but.. we have all been ED before. I have hired an attorney and he has a previous relationship with the prosecutor. I should get the discovery the day of entering the plea or within 10 days thereafter. | |
